DescriptionCould somebody ask for "Amparo" invoking the right to life of a prisoner who refuses to receive feeding because he is in a hunger strike? The Constitutional Tribunal has admitted resources of "Amparo" by honor injury, privacy, or own image of passed away persons and even by Jewish people who defend their right to honor originated by declarations that ridiculed the holocaust. The Constitutional Tribunal has also legitimized a Prolife association in order to oppose legal dispositions related to the legal practice of interruption of pregnancy; it has also legitimized freedom of association by professors of religion to oppose a determination that prevented them to be directors of public centers. The autor explains in this interesting article that these assumptions have appeared due to the legitimate expression that seems to indicate that procedural legitimization does not have any reason to derive from the titularity of a person"s fundamental right, but it can also be held by any people that shows interest for his defense.en-US
Description¿Podría alguien acudir en amparo, invocando el derecho a la vida de un preso que se niega a recibir alimentación por estar en huelga de hambre? El TC ha admitido recursos de amparo por lesión al honor, a la intimidad o a la propia imagen de personas fallecidas e incluso por personas de raza judía que defienden su derecho al honor frente a declaraciones que ridiculizaban el holocausto. Igualmente, el TC ha aceptado la legitimación de la asociación Provida para impugnar disposiciones jurídicas relacionadas con la práctica legal de la interrupción del embarazo o bien de una asociación de profesores de religión para impugnar una determinación que les impedía ser directores de centros públicos. Estos supuestos se han presentado, nos explica el autor de este artículo, gracias a que la expresión "interés legítimo" parece indicar que la legitimación procesal no tiene por qué derivar de la titularidad del derecho fundamental de una persona, sino que también puede tenerla quien ostenta sólo un interés para su defensa.es-ES
