In this article we will study the absence of an explicit regulation of the simulation on the subject of civil marriage. After a brief reference to the state of the matter in Canon Law, we analyze the discipline given to the subject by the CC and by the LMC of 1884. We will then study the discussions regarding the simulation that emerged during the course of the project of Law that would become Law Nº. 19,947, to ἀnally refer to the absence of an express treatment of the simulation in the NLMC, the above does not preclude its punishment with the non-existence.En el presente artículo se estudia la falta de una regulación explícita de la simulación a propósitodel matrimonio civil. Luego de una breve referencia al estado de la cuestión en el derecho canónico, se analiza la disciplina otorgada a la materia por el CC y por la LMC de 1884. A continuación, se estudian las discusiones relativas a la simulación surgidas durante la tramitación del proyecto de ley que se convertiría en la Ley Nº 19.947, para ἀnalmente referirnos a la ausencia de tratamiento expreso de la simulación en la NLMC, lo que no impide que dicho supuesto sea sancionado con la inexistencia.
