The transposition of the Consumer Rights Directive of 2011 to the spanish legal system fully harmonized the exceptions to the right of withdrawal in respect of contracts concluded outside commercial establishments and of distance contract. The article 93 to the General Law for the Protection of Consumers and Users and other complementary laws on 2007 previse total exceptions. Likewise, the article 103 to the normative aforementioned, previse biased exceptions, which justified due to the nature of the products, as the case may be and as we shall see in this paper.Con la transposición de la Directiva de los Derechos de los Consumidores de 2011 al ordenamiento jurídico español, se armonizaron plenamente las excepciones al derecho de desistimiento en materia de contratos celebrados fuera de los establecimientos mercantiles así como de contratación a distancia. El artículo 93 del Texto Refundido de la Ley de Consumidores y Usuarios de 2007 prevé excepciones totales. Asimismo, el artículo 103 de la normativa mencionada prevé excepciones parciales, las cuales se justifican debido a la naturaleza de los productos o servicios, según sea el caso, tal y como veremos en el presente trabajo.
