The article discusses the evolution of the concept of property in Mexican law, influenced by Léon Duguit and the development of the social function of property. It examines the theoretical foundations of property as a social duty subject to rules and limitations for the benefit of the public interest, as reflected in article 27 of the Mexican Constitution of 1917 and the Civil Code of 1928. A new conception of property is presented, and a certain disconnect between theory and the provisions of the code is highlighted, leading to discussions and debates about property in the mexican context.El artículo aborda la evolución del concepto de propiedad en el derecho mexicano, influenciada por Léon Deguit y el desarrollo de la función social de la propiedad. Se analizan las bases teóricas de la propiedad como un deber social sujeto a reglas y limitaciones en beneficio del interés público, reflejado en el artículo 27 de la Constitución mexicana de 1917 y el Código Civil de 1928. Se plantea una nueva concepción de la propiedad, se señala cierta desconexión entre la teoría y las disposiciones del Código, lo que lleva a discusiones y debates sobre la propiedad en el contexto mexicano.
