The purpose of this study is to carry out a legal analysis that highlights the importance of establishing a cinematheque in Peru and its relationship with human rights. Through a legal and cultural approach, focusing on the right of access to culture, the right to cultural heritage, the right to identity and the right to memory. It is concluded that the Peruvian Cinematheque would not only preserve the cinematographic heritage, but would also facilitate the exercise of these rights and contribute to the strengthening of cultural identity and historical memory. This study highlights the relevance of audiovisual preservation in the current context, considering the threat of loss of audiovisual and cinematographic records in Peru due to the lack of adequate measures for their conservation. Its originality lies in its interdisciplinary approach that links human rights with the preservation of audiovisual heritage. Therefore, the Peruvian Cinematheque, as a cultural entity, emerges as an ideal space to materialize these rights and enrich the cultural identity and historical memory of the country.El propósito de este estudio es realizar un análisis jurídico que destaque la importancia de establecer una cinemateca en Perú y su relación con los derechos humanos. A través de un enfoque jurídico y cultural, centrándose en el derecho de acceso a la cultura, el derecho al patrimonio cultural, el derecho a la identidad y el derecho a la memoria. Se concluye que la Cinemateca Peruana no sólo preservaría el patrimonio cinematográfico, sino que también facilitaría el ejercicio de estos derechos y contribuiría al fortalecimiento de la identidad cultural y la memoria histórica. Este estudio destaca la relevancia de la preservación audiovisual en el contexto actual, considerando la amenaza de pérdida de registros audiovisuales y cinematográficos en Perú, debido a la falta de medidas adecuadas para su conservación. Su originalidad radica en su enfoque interdisciplinario que vincula derechos humanos con la preservación del patrimonio audiovisual. Por lo tanto, la Cinemateca Peruana, como entidad cultural, emerge como un espacio idóneo para materializar estos derechos y enriquecer la identidad cultural y la memoria histórica del país.
