The purpose of this paper is to study the exercise of the rights granted by Law No 27,610 of Access to the Voluntary Termination of Pregnancy by persons with disabilities. This paper suggests a legal approach, through a systemic analysis of all the domestic regulations involved, at different hierarchical levels, so as to assess their interpretation and application in compliance with the human rights standards, which prevail in the Argentine legal system. Legal contradictions arise between the abovementioned Law No 27,610 and the Argentine Civil and Commercial Code, mainly concerning persons with disabilities absolutely unable to interact with their environment, and thus unable to express their consent. This paper aims to cast light on this contradiction and pose it as a problem in pursuit of regulatory harmonization so as to prevent it from leading to either human rights violations or misinterpretations in practice. The framework of this paper is within the recent enactment of the abovementioned law which gives access to the voluntary termination of pregnancy. Hence, this has become a historical and legal milestone, not only in this country but in all Latin America. This paper aims to provide some contributions and answers to issues still open which are posed as challenges by the recent application of Law No 27,610 with the strong belief that this will contribute to the anticipation, prevention and resolution of legal conflicts in this field.El presente artículo tiene como finalidad el estudio del ejercicio de los derechos reconocidos en la ley argentina 27.610 de Interrupción Voluntaria del Embarazo por personas con discapacidad. Para ello, se propone un abordaje jurídico a través del análisis sistémico de toda la normativa nacional involucrada, de diversos niveles jerárquicos, para su interpretación y aplicación armónica a la luz de los estándares de derechos humanos, que constituyen una perspectiva obligatoria en el ordenamiento argentino. De este modo, se detectan contradicciones jurídicas, principalmente entre la referida ley 27.610 y el Código Civil y Comercial de la Nación Argentina, cuando se trata de personas absolutamente imposibilitadas de interactuar con el entorno y, por ende, de manifestar su voluntad para la práctica. Así, se busca visibilizar dicha contradicción y problematizarla hacia la compatibilización de la aplicación normativa, de modo que en los hechos no implique conculcaciones de derechos humanos ni fallas interpretativas. Lo expuesto se enmarca en la reciente sanción de la referida ley argentina que permite el aborto voluntario, constituyendo un hito histórico y jurídico no sólo para dicho país sino también para toda América Latina. En consecuencia, se busca en este artículo brindar aportes y respuestas a interrogantes aún abiertos que plantea, como desafíos, la incipiente aplicación de la ley argentina 27.610, con la convicción de que ello contribuya a la anticipación, prevención y resolución de conflictos jurídicos en la materia.
