In the present study the Spanish criminal regulation on protection of religious feelings is analyzed, as well as the criticisms that have been made to its maintenance. An assessment of European Comparative Law is made, taking into account the German, Italian, Portuguese and French legal systems, and it is noted that the protection of such feelings is the general rule. In addition, it studies the relations between the State and religious denominations, the different systems are compared and the conclusion is reached that in Spain there is a positive laic system. Ultimately, it is analyzed if offenses can be constitutive of crime, if feelings are susceptible to criminal protection, and if it is legitimate to criminally protect religious feelings. In addition, it responds to criticisms to the Spanish Penal Code in this matter and proposes the restriction of article 525 of the Spanish Code.En el presente estudio se analiza la regulación penal española sobre protección de los sentimientos religiosos, así como las críticas que se han efectuado a su mantenimiento. Se hace una valoración del derecho comparado europeo, atendiendo a los ordenamientos alemán, italiano, portugués y francés, y se constata que la protección de tales sentimientos es la regla general. Además, se parte del marco de relaciones entre el Estado y las confesiones religiosas, se comparan los diferentes sistemas y se llega a la conclusión de que en España existe un sistema de laicidad positiva. En último término se estudia si las ofensas pueden ser constitutivas de delito, si los sentimientos son susceptibles de tutela penal, y si es legítimo proteger penalmente los sentimientos religiosos. Además, se responde a las críticas al Código Penal español en esta materia y se propone de lege ferenda la restricción del artículo 525 del Código Penal.
