This article is part of a study on policy measures on industrial property that Colombia has implemented to fulfill its obligations under the FTA with the United States. Among these measures we find the Decree 729 of 2012 with which Colombia ends up accepting changes to its rules on the protection of geographical indications (GI) to accommodate the rules established by the U.S. in this subject. Thus, first, we will study the regulation of GI in the WTO to show how the lack of consensus on which system of protection of GI should prevail has led to a conflict between the United States and the European Union that is reflected in trade agreements with other nations. Then, we will analyze the main changes the Colombian Legal System experiences with the protection of GIs through collective or certification marks and the application of the priority rule that operates in the trademark system of the United States. Finally, we will present conclusions about the possible solutions that may be adopted to eliminate the consequences that this situation can bring for international trade players in Colombia.Este artículo pertenece a un estudio acerca de las medidas normativas sobre propiedad intelectual que Colombia ha implementado para cumplir con el TLC con Estados Unidos. Entre esas medidas encontramos el Decreto 729 de 2012 con el que Colombia terminó aceptando variaciones a sus reglas sobre la protección de indicaciones geográficas (IG) para acomodar las reglas establecidas por Estados Unidos en esta materia. Así, en primer lugar, estudiaremos la regulación de las IG en la OMC para mostrar cómo la falta de consenso sobre el sistema de protección que debe prevalecer ha origina do un conflicto entre Estados Unidos y la Unión Europea, que se refleja en los acuerdos comerciales que impulsan con otras naciones. En seguida, analizaremos los principales cambios que genera para el sistema legal colombiano la protección de las IG a través de marcas colectivas o de certificación y la aplicación de la regla de prioridad en el tiempo que opera en el sistema marcario de Estados Unidos, para finalmente presentar conclusiones de las posibles soluciones que podrían adoptarse para eliminar las consecuencias que esta situación puede traer para los actores del comercio internacional en Colombia.
