THE CASE OF OAXACA Rubén VASCONCELOS MÉNDEZ** This paper aims to analyze the principle of autonomy of the Public Ministry in the light of recent reforms to the Constitution and taking as benchmark the case of Oaxaca. This arises, due to the implementation of a system of criminal justice in the State, the need to adapt the present conception of the nature of the State prosecutor for the new functions that he has been attributed and the need to analyze the institutional and procedural activity to determine the meaning of the principle of autonomy of the institution and its representatives,which will be implemented by various means such as the institutional location, the appointment of its holder, the career professional service, among others. THE CASE OF OAXACA Rubén VASCONCELOS MÉNDEZ** Este trabajo tiene por objeto analizar el principio de autonomía del Ministerio Público a la luz de las recientes reformas a la Constitución de la República, tomando como punto de referencia el caso de Oaxaca. Debido a la implementación en el Estado de un sistema penal acusatorio, se plantea la necesidad de adecuar la concepción actual sobre la naturaleza del acusador estatal por las nuevas funciones que se le han atribuido, y la necesidad de analizar su organización institucional y su actividad procesal para poder determinar el significado del principio de autonomía de la institución y sus agentes, mismo que se concreta a través de diversas vías tales como la ubicación institucional, el nombramiento de su titular, el establecimiento del servicio profesional de carrera, entre otras.
