It is necessary to understand the phenomenon of globalization in order to explain the liberalization of those services and their restructuring, on the basis of the guidelines established by the WTO. This essay seeks to analyze Mexico’s financial services, in the framework of the WTO, and in the light of different free trade agreements that Mexico has signed. The author explains that the financial system constitutes a basic infrastructure of the country’s economy, and that for this reason it is necessary to develop a proper regulatory regime in order to allow greater liberalization of this sector, within the context of globalization. In this sense, the goal would be to produce a legal framework to bring about legal certainty, which in turn is required to achieve the benefits of financial deregulation, taking into account the institutional development of the countries that are parties to free trade agreements. Es necesario entender el fenómeno de la globalización para explicar la liberalización de los mencionados servicios y su reestructuración a partir de los lineamientos establecidos por la OMC. Este ensayo se propone como objetivo analizar el sector de los servicios financieros mexicanos en el marco de la Organización Mundial de Comercio, a la luz de los diversos tratados de libre comercio que México ha suscrito. La autora explica que el sistema financiero constituye una infraestructura básica de la economía de un país, motivo por el cual se requiere de una reglamentación cautelar que permita mayor liberalización de este sector, dentro del contexto de la globalización. En este sentido, la meta sería generar un entorno que proporcione seguridad jurídica para alcanzar los beneficios de la desregulación financiera, tomando en cuenta el desarrollo institucional de los países miembros de cualquier tratado de libre comercio.
