This paper has as its objective, on the one side, to give a critical account of the positivist and formalist legal theory, the kelsenian pure theory of law, in particular. On the other hand, to analyze the cosmovision and the circular form of legality held by the indigenous people, especially those of the AbyaYala.El presente trabajo tiene como objetivo, por un lado, abordar críticamente la postura de lateoría jurídica postivista y formalista, sobre todo la de teoría pura del Derecho de Hans Kelsen, conla cosmovisión y la forma circular de la juridicidad de los pueblos indígenas, especialmente aquellos deAbya Yala.
