The Best Interest of the Child (BIC) does not provide us with general solutions, but rather provides an instrument for weighting the relevant circumstances, which can lead to a solution or another completely different, depending on the context in each case and, of the specific child in relation to whom the measure is to be adopted.Despite the relevance of the BIC in how many decisions can directly or indirectly affect a child or a group of them, we have to be aware of, like the rest of the legal institutions, the weighting element is implicit in those, to try to balance interests in presence and avoid unwanted solutions.El Interés Superior del Niño (ISN) no nos aporta soluciones generales, sino que proporciona un instrumento de ponderación de las circunstancias relevantes en presencia, lo que nos puede conducir a una solución u otra diferente, en función de cuál sea el contexto en cada caso y, del niño concreto en relación con el cual se vaya a adoptar la medida.A pesar de la relevancia del ISN en cuantas decisiones puedan afectar directa o indirectamente a un niño o a un grupo de ellos, tenemos que ser conscientes de que, como el resto de las instituciones jurídicas, el elemento de ponderación está implícito en aquellas, para intentar equilibrar los intereses en presencia y evitar soluciones indeseadas.
