In the following paper, the authors analyze the different theories about the legal nature of the Arbitration and, notably the position taken by the Peruvian Constitutional Court, which puts to the Arbitration in a dangerous situation.En el presente artículo, los autores analizan las diferentes teorías acerca de la naturaleza jurídica del arbitraje y, en particular, la postura asumida por el Tribunal Constitucional peruano, que coloca al arbitraje en una situación peligrosa.
