Penal punishment implies using the force of the State to harm someone. In the case of prisons, not only does it mean depriving a person of her freedom, but also implies a violent and degrading act, not just for the offender, but also for her family. How can we, as a society, justify penal punishment? This article raises the question of whether criminal punishment (particularly the use of prisons) can meet the goals that Consecuentialist and Retributive theories of criminal punishment offer as justifications for the use of criminal punishment.La imposición del castigo penal implica utilizar el aparato del Estado para producir un daño a alguien. En el caso de las penas privativas de libertad, el castigo penal implica, no sólo privar de la libertad a una persona, sino, además, frecuentemente constituye un acto violento y degradante no sólo para los ofensores sino también para sus familiares. ¿Con qué fines justificamos, como sociedad, la imposición de castigos penales? En este texto se aborda la pregunta sobre si los castigos penales, particularmente las penas de prisión, cumplen con los fines que desde el utilitarismo (o consecuencialismo) y el retribucionismo se les imputa.
