The use of new technologies in corporate communications, mainly the Internet and email, as well as the telephone, has given rise to a new discussion in the workplace about the limits of the employer or business owner to monitor and control the use of these communication tools and to what extent these actions may or may not affect the privacy of employees. This issue is clarified in this paper, with particular reference to the monitoring of telephone communications in the company and its problems in light of the crime of intervention in private communications.La utilización de nuevas tecnologías en la comunicación de las empresas, principalmente internet y correo electrónico, además del teléfono, ha suscitado una nueva discusión en el ámbito laboral acerca de cuales son los límites del patrón o empresario para vigilar y controlar el uso de esas herramientas de comunicación y hasta donde esas acciones pueden o no afectar el ámbito de la intimidad de los empleados. En el presente trabajo se dilucida tal cuestión, con una particular referencia a la vigilancia de las comunicaciones telefónicas en la empresa y su problemática a la luz del delito de intervención de comunicaciones privadas.
