La resolución de la Contradicción de Tesis 293/2011 significa un avance y un retroceso, pues si bien estableció que los derechos humanos sin distinción alguna de la fuente de donde provienen, ya sea convencional o constitucional, constituyen el parámetro de control de regularidad constitucional, así como que la jurisprudencia de la Corte Interamericana de Derechos Humanos es vinculante para los jueces mexicanos, estableció una restricción que delimita la interpretación del artículo 1º constitucional, limitando la justiciabilidad de los derechos humanos.The resolution of the contradiction 293/2011 means an advance and a retreat, because although it established that human rights, without distinction of the source they come from, whether conventional or constitutional, constitute the control parameter of constitutional regularity, and that the jurisprudence of the Interamerican Court of Human Rights is binding for mexican judges, it established a restriction which delimits the interpretation of 1st constitutional article, limiting the justiciability of human rights.
