Millions of people around the world have been forced to move due to natural disasters and the negative effects of climate change. This situation has sparked the academics’ interest in develop their studies from different fields of knowledge to make this issue a global problem must be solved, which has not been achieved even thought the creation of the 2030 Agenda. Thus, this article aims to do a sociological-legal study on a global scale about the evolution of the legal recognition and the climate and environmental migrants’ justiciable character from the perspective of human rights.Millones de personas alrededor del mundo han sido obligadas a desplazarse producto de los desastres naturales y los efectos negativos del cambio climático, lo cual ha despertado el interés de la academia en abordar su estudio desde distintos ámbitos del conocimiento, que son necesarios interrelacionar para hacer del asunto un problema global que, ni con oportunidad de la Agenda 2030, se ha logrado resolver. Así, el objetivo de este trabajo consiste en realizar un estudio sociológico-jurídico a escala global sobre la evolución del reconocimiento jurídico y posible carácter justiciable de los desplazados climáticos y medioambientales desde los derechos humanos.
