The right to health protection in the Spanish Constitution loses effectiveness in a context of increasing needs, expenditure growth and implementation of cost containment policies. Looking ahead to the coming debates, it is essential to analyze the principles that would allow order, rank and link health needs and Constitutional protection. On this basis, a proposal is made to enrich the political, legal and social debate, involving the articulation of the three types of Constitutional protection -reinforced, tutored, and selective, with twelve categories of need in the three dimensions of individual, social and economic harm.El derecho a la protección de la salud en la Constitución Española pierde efectividad en un contexto de aumento de necesidades, crecimiento de costes y de aplicación de políticas de contención del gasto. De cara a los próximos debates, es esencial analizar los principios que permitirían ordenar, jerarquizar y vincular necesidades sanitarias y protección constitucional. Sobre esta base se formula una propuesta para enriquecer el debate político, jurídico y social, consistente en la articulación de los tres bloques de protección -reforzada, tutelada y selectiva-, con doce categorías de necesidad en los tres ámbitos de perjuicio individual, social y económico.
