The legal status of married women reveals the prevailing consideration of their nature and capacity, testifying, with the survival of certain provisions from Spanish historical law to the existence of a misogynist past, but also of a present which, if it does not exacerbate discrimination against women because of their sex, it perpetuates it. Proof of this can be found not only in the regulations in force, but also in the novels adhering to the realist and naturalist literary trend that emerged throughout the century. As a result, this study combines the analysis of both literary and legal knowledge to outline a more approximate historical reality of the position and circumstances surrounding nineteenth-century Spanish women with regard to their only legitimate destiny: marriage.El estatus jurídico de la mujer casada revela la consideración imperante acerca de su naturaleza y capacidad, testimoniando, con la supervivencia de ciertas disposiciones procedentes del Derecho histórico español la existencia de un pasado misógino, pero también de un presente que, sino agudiza aún más si cabe la discriminación hacia las mujeres a causa de su sexo, la perpetúa. Prueba de ello ofrece no solo la normativa vigente, sino también los relatos costumbristas o las novelas adheridas a la corriente literaria realista y naturalista que emergen a lo largo de todo el siglo. Fruto de ello en este estudio se conjuga el análisis de ambos saberes, literario y jurídico, para esbozar una realidad histórica más aproximada de la posición y circunstancias que rodean a las españolas decimonónicas en torno a su único destino legítimo: el matrimonio.
