The fishing played a fundamental role in the economy of the coastal towns of the Mediterranean throughout Antiquity. Historically, it was an important activity in all the coastal regions of Spain. However, with the increase in knowledge and the evolution of technology, it has been found that although fishery resources are renewable, they are not infinite, and therefore free access to fishing must be restricted. Through a brief historical analysis, the intention is to elucidate whether the limitations of access to fishing activity have existed in the Spanish law of the past, revealing the differences between the solutions proposed by this system throughout time.La pesca desempeñó un papel fundamental en la economía de los pueblos ribereños del Mediterráneo durante toda la Antigüedad e históricamente fue y ha sido una actividad importante en todas las regiones costeras de España. Sin embargo, con el aumento de los conocimientos y la evolución de la tecnología, se ha constatado que aunque los recursos pesqueros son renovables, no son infinitos, debiendo ser restringido, por tanto, el libre acceso a la pesca. Mediante un breve análisis histórico se pretende dilucidar si las limitaciones de acceso a la actividad pesquera han existido desde antaño en el Derecho español, revelando las diferencias entre las soluciones propuestas por dicho sistema a través del tiempo.
