The recognition of rhetoric as an essential dimension to the legal phenomenon corresponds to the conception of Law assumed by the Communicational Theory of Law, as a text of a regulatory or directive nature that finds in the language of jurists a universal means of expression. It is the constitutional legal field that offers the opportunity to clarify the process of significant construction of the Law from the prenormative instances of the constituent discourse to the normative ones, characteristics of the properly constitutional discourse. Argumentation and ideology are shown as fundamental elements within this communicative process of the legal world, where rhetoric becomes an epistemological substrate that affects the very nature of the constitutional phenomenon.El reconocimiento de la retórica como una dimensión esencial al fenómeno jurídico se corresponde con la concepción del derecho asumida por la teoría comunicacional del derecho, como texto de naturaleza regulativa o directiva que encuentra en el lenguaje de los juristas un medio de expresión universal. Es el ámbito jurídico constitucional el que brinda la oportunidad de esclarecer el proceso de construcción significativo del derecho desde instancias prenormativas del discurso constituyente hasta las normativas, características del discurso propiamente constitucional. La argumentación y la ideología se muestran como elementos fundamentales dentro de este proceso comunicativo del mundo jurídico, donde la retórica se convierte en un sustrato epistemológico que afecta la naturaleza misma del fenómeno constitucional.
