DescriptionConstitutionalism is a result of the enlightened thinking of the 17th and 18th centuries. Constitutional Law is one of the most important human creations to program and order the coexistence of citizens within the State. Constitutional Law stems from constitutions, a concept born in the 17th century. Now, in the modern age, this branch of the law is also developed through the provisions of international human rights treaties. Paying tribute to the “Enlightment” or “Age of Reason,” the ideas proposed are presented in the manner of a Discourse on constitutional law. Primary Colors, i.e. a reasoning process (discourse), reviewing each of the three courses of the term analyzed: a) constitutional law, the objective law stemming from the system of the Federal Constitution of the Argentine Republic; b) fundamental rights, desires, or hopes of individuals; and c) the area of scientific knowledge: constitutional theory. This theoretical analysis is mainly focused on the federal system of the Argentine Republic. Nevertheless, the intention of this analysis is to participate in, profit from, and promote critical discussion in the Americas and Spain.en-US
DescriptionEl constitucionalismo es un producto del pensamiento ilustrado de los siglos XVII y XVIII. El derecho constitucional es una de las más importantes creaciones humanas para programar y ordenar la convivencia de los ciudadanos en el marco del Estado. El derecho constitucional emana de las constituciones, ideación nacida en el siglo XVII; y, ahora, que en la modernidad, también se desarrolla a partir de las mandas de los instrumentos internacionales de derechos humanos. En homenaje a la “ilustración” o siglos de las luces, las ideas propuestas se presentarán en forma de “Discurso sobre el derecho constitucional. Colores primarios”, es decir, un proceso de razonamiento (discurso), en el que se pasa revista a cada uno de los tres cursos del término analizado: a) derecho constitucional, derecho objetivo que emana del sistema de la Constitución federal de la república Argentina; b) derechos fundamentales, pretensiones o esperanzas de los sujetos y c) el área propia del saber o dominio científico la dogmática o teoría constitucional. La composición teórica fija su atención, preferentemente, en el sistema federal de la Argentina. Sin embargo, tiene la esperanza y expectativa de que pueda participar, aprovechar y promover el debate crítico en los contextos americanos e ibéricos.es-ES
