In present times, nobody questions the preeminence of the right to privacy in view of an unstoppable modernity that invades the delicate and intricate areas of everyday life; without adequate tutelage in the systems enforceable in our country. There is a real construction of the aforementioned law, before a scant jurisprudence, not just by determining the scope and conceptualization of the same and the confusion that seems to mediate in its contents, between intimacy and privacy. Within the complexity reflecting its tutelage, the issue of the scope of its contents and coverage its of high relevance giving that its implicit safeguarding, recognized by the court, we come to the final conclusion that the scopes and coverage it´s of high relevance, given its implicit safeguarding of intimacy. The present work is aimed to clarify some of the indefinite questions and points related to the tutelage and the right to vindicate the necessary safeguard differencing privacy and the diversity of areas and subjects comprised in the subject and the necessary safekeeping and expressed in the fundamental law and not implicitly trough in mechanisms of tutelage.En la actualidad nadie pone en tela de juicio la preeminencia del derecho a la intimidad, ante una modernidad imparable, que invade las esferas más intrincadas de la vida cotidiana del ser humano, sin una tutela adecuada en los ordenamientos vigentes en nuestro país, se pone de relieve que no existe una real construcción del referido derecho, ante una escasa jurisprudencia, que no acaba por determinar los alcances y conceptualización del mismo y la confusión que parece mediar entre intimidad y privacidad en su contenido. Dentro del entramado complejo que su tutela refleja, el tema de los alcances y contenido, no es de poca relevancia, dada su salvaguarda implícita que ha sido reconocida por la Corte, arribamos a la indefectible conclusión, de que ni siquiera ha sido mencionado de manera expresa como derecho fundamental y, vista la diferenciación de los ámbitos que tradicionalmente han diversificado a las personas, y en los que la intimidad guarda un espacio de particular importancia, el presente trabajo pretende determinar cuál es el contenido protegido por el derecho a la intimidad y derivado de ello establecer las diferencias entre el derecho fundamental otros derechos no comprendidos en él y sus mecanismos de tutela para poder acceder a una adecuada salvaguarda del mismo.
