This paper deals with the relationship between metaphysical and legal freedom. Metaphysical freedom is challenged by Mechanism, but cannot be neglected by human beings, whereas legal freedom reduces to what is permitted, ordered, or prohibited by legal norms. It might be that legal freedom is metaphysical freedom despite some asymmetries between them. Moreover, legal freedom could be considered in its positive sense and applied to promote the flourishing of persons. Thus it is proposed a reading of the mexican Constitution in a way that the right to education stated in article 3o. would provide citizens with a number of capacities and dispositions strong enough to resist any diminishing or supressing of such personal liberties as the liberty of religious belief, the liberty of expression and the liberty of movement. Furthermore, assuring those liberties will bring about a kind of robust, creative, flourishing human beings.Este trabajo explora las relaciones entre la libertad metafísica y la jurídica. La primera, aun cuando se le considera como una necesidad para el ser humano, es cuestionada por el mecanicismo; la segunda se reduce a lo permitido, lo ordenado y lo prohibido por las normas jurídicas, concibiéndose históricamente como una libertad negativa. Sin embargo, si a pesar de algunas asimetrías existe una relación con la libertad metafísica deberá entenderse al derecho como afirmando la libertad positiva que propicia el florecimiento de las personas. En esta línea, se propone una lectura creativa de la Constitución y de tres tipos de libertades que ésta protege, a saber, la libertad religiosa, la de expresión y la de movimiento. Partiendo de la obligación del Estado a impartir educación, según las especificaciones constitucionales, encontraremos que de cumplirse este artículo se dotaría de capacidades y disposiciones a las personas para resistir a cualquier persona o institución que quiera restringir o eliminar sus libertades; más aun, al afirmar esa libertad en una forma creativa se propiciará su florecimiento.
