When the spanish judge is about to apply a national norm facing of a comunity norm which one have to chose? The judges of the European Union members countries have the obligation to take care that their resolutions not infringe the community norms. But the judge should have to apply the community norm to obtain a "community or constitutionalist control", helping himself with the prejudicial matter as a consultation to the Luxembourg Court.¿A qué norma deberá hacer caso el juez español cuando se encuentre ante una norma nacional y una comunitaria que se contrapongan? Los jueces de los países miembros de la Unión Europea tienen la obligación de cuidar que en sus resoluciones no se contravengan normas comunitarias. Pero el juez deberá aplicar la comunitaria para lograr con ello un "control de comunitariedad" o "constitucional", auxiliándose también de la cuestión prejudicial en cuanto consulta que pueden someter al Tribunal de Luxemburgo.
