The operative concept most frequently used by legal dogma in dealing with the right to privacy and intimacy, refers to the idea of negative freedom as evidenced in this text. What occurs, however, is that this idea, when adopted by an influential line of liberal thought, fails to provide clear and measured criteria consistent with the limitations of liberty for each individual and, therefore, the minimum limits of privacy which he is to receive. The article is in favor of the need to use pragmatic criteria (rather than logical ideals and principles) for measuring privacy, based on the concept of normality, defined according to the rules of social judgment as to what a provisional, suitable and reflexive restriction between public and private consists of. Based on these rules, a system can be established for regulating market information and its effects while taking the right to privacy into consideration.El concepto operativo más frecuentemente utilizado por la dogmática jurídica en el tratamiento del derecho a la privacidad e intimidad alude a la idea de libertad negativa, como se evidencia en este texto. Sucede, no obstante, que tal idea tomada por un influyente linaje del pensamiento liberal, no presenta criterios claros y medidas consistentes sobre los límites de la libertad de cada uno y, consecuentemente, sobre los límites mínimos de la privacidad que debe ser garantizada a cada individuo. El artículo está a favor de la necesidad de utilizar criterios pragmáticos (y no ideales y principios lógicos) de medición de la privacidad, a partir del concepto de normalidad, definido a partir de las reglas de juzgamiento social acerca de lo que es el límite provisorio, adecuado y reflexivo de la medida de lo público y lo privado. A partir de estas reglas se podrá establecer un sistema de regulación de la información en el mercado y sus efectos, pero teniendo en cuenta el derecho a la privacidad.
