This work amends the defense of a social state of law in the face of criticism by Socialist and Neo-Liberal authors. It begins by justifying the existence of the national state, and then goes on to expound on the historic development of the notion of a Social State both in Mexico and in Germany, combined with a need to include social market economics in Constitutional texts. The rest of the work reviews some matters in which the contemporary Social State should take a new stand; the social politics, especially in the fight against poverty, decentralization and Federalism, in order to permit greater regional balance and a harmonious development of the country, together with the establishment of methods for participation by the masses and the reaffirmation of State supervision of economic matters and of its role as the promoter of national development.En este trabajo se retoma la defensa del Estado social de derecho frente a las críticas que han sido formuladas en su contra por parte de autores socialistas y neoliberales. Inicia justificando la existencia del estado nacional y enseguida expone el desarrollo histórico de la noción de Estado social tanto en México como en Alemania, vinculándolo con la necesidad de incluir en los textos constitucionales el principio de economía social de mercado. En el resto del contenido se hace una revisión de algunos temas en los que el Estado social contemporáneo debe reposicionarse: políticas sociales, especialmente en la lucha contra la pobreza; descentralización y federalismo para permitir mayores equilibrios regionales y un desarrollo armónico en el desarrollo del país; así como la creación de mecanismos de participación popular y la reafirmación de la rectoría estatal en materia económica y de su papel promotor del desarrollo nacional.
