The present article intends to provide a general overview of the active role played by constitutional courts in the emer-ging democracies of Central and Eastern Europe, in their capacity as guarantors of a constitutional order and, more specifically, as protectors of the fundamental rights granted by their respective fundamental laws. The article begins by describing, in a brief manner, the fundamental rights that those constitutions typically recognize. It provides next a notion of the mode and manner in which the constitutional courts (belonging to seventeen countries) have been established and regulated by the constitutions and their by-laws. The cen-tral part of the article consists of an analysis of the instruments employed by the constitutional courts for carrying out their task of protecting fundamental rights, providing also numerous examples of the problems they have faced and the decisions they have adopted in this respect.Un panorama general del activo papel que los tribunales constitucionales han venido ejerciendo en las nacientes democracias de Europa Central y Oriental, en su condición de garantes del orden constitucional y, más específicamente, de protectores de los derechos fundamentales reconocidos por sus respectivas leyes básicas, es el motivo de este artículo. El trabajo comienza exponiendo de forma sintética cuáles son los derechos fundamentales que dichas Constituciones típicamente reconocen, brindando a continuación algunas nociones acerca del modo en que dichos tribunales constitucionales (que pertenecen a diecisiete países) han sido establecidos y conformados por los textos constitucionales y legales. La parte central del trabajo analiza los instrumentos a través de los cuales los tribunales llevan a cabo su misión de proteger los derechos fundamentales, ofreciendo ejemplos de los problemas concretos que han enfrentado y las resoluciones que han dictado al respecto.
