Chile’s attempt to implement a legal system reform with accusatorial characteristics makes it necessary to examine whether they can actually be detected in the new adjective legal system. In comparing the principles that characterize an inquisitorial system with those of an accusatorial system, it is possible to observe, in the Chilean reform phenomenon, not only the weakened application of some principles which supposedly are basic to an accusatorial penal system, but also the lack of one which founded both the French revolutionary legal system and that of the other European Latin American legal systems from the XIX century on: the principle of lay judges’ participation.El intento chileno por implementar una reforma procesal penal con rasgos acusatorios obliga a examinar si, efectivamente, se detectan esos rasgos en el nuevo sistema penal adjetivo. Al comparar los principios que caracterizan un sistema inquisitorio con los que modelan un sistema acusatorio, es posible advertir, en el fenómeno reformatorio chileno, no sólo la aplicación debilitada de algunos principios que, se supone, son fundamentales en un sistema procesal penal de corte acusatorio sino también la ausencia de uno que cumplió la función fundacional del sistema revolucionario procesal francés que sirvió de base a los restantes ordenamientos jurídicos occidentales europeos y latinoamericanos a partir del siglo XIX: el principio de participación de jueces legos.
