The joint and several obligation, a multi-secular institution with great practical application, has been the subject of new analyses on its structure and operation. These analyses have been made within the modernization process of the law of contracts, principally on the basis of various European harmonization instruments, but extend to other regions. This paper tries to explain the way in which passive solidarity is being understood in this new context and its potential impact on the Chilean Civil Code, either by the possible amendment of certain of its provisions or, by the change in the way they are construed.La obligación solidaria, una institución multisecular y de gran aplicación práctica, ha sido también objeto de nuevos análisis sobre su estructura y operatividad dentro de los esfuerzos que se han realizado para modernizar el derecho de los contratos sobre la base de diversos instrumentos de armonización prioritariamente europeos, pero que se extienden a otras regiones. El trabajo intenta exponer de manera sintética la forma en que está siendo comprendida la solidaridad pasiva en este contexto, así como su posible repercusión en el Código Civil chileno, que podría darse por reforma de sus disposiciones en ciertos casos o por la mera reinterpretación de otras.
