This paper will examine the current state of the system of product liability in Chile. In absence of law that regulates the fabricant’s liability, will discuss the general rules of the chilean private law. In lack of treatment in a civil case law on the subject, as there are product liability judgments, will investigate whether through the consumer law would be possible to pursue fabricant’s product liability. The hypothesis of this work is that under article 23 of consumer law it is possible to reach the joint responsibility of the manufacturer and seller.en este trabajo se examinará el estado actual del régimen de responsabilidad por productos defectuosos en chile. en ausencia de una ley especial que regule la responsabilidad civil del fabricante, se analizarán las disposicio­nes generales del derecho común. a falta de tratamiento jurisprudencial en sede civil sobre el tema, y como existen sentencias judiciales sobre productos defectuosos, se investigará si por medio de la ley del consumo sería posible perseguir la responsabilidad del fabricante. La hipótesis de este trabajo es que bajo el artículo 23 de la ley del consumo sería posible perseguir la responsabilidad conjunta del fabricante y el vendedor.
