The trends of a civil proceeding by hearings with the improvement of all the administrative and financial conditions of the civil justice system does not seem to be enough; it also requires setting new roles for the judge (and courts) and the parties. On the judge’s side, a vision is imposed that assumes an active role as manager and driver. In this way, a symbiosis between the adversarial and inquisitorial systems is verified. The contemporary legal-procedural comparative culture begins to be conditioned by the need for a close judge and with an empathetic intervention with the parties and their representatives that requires new paradigms. On the side of the parties, the competition between the parties to obtain a positive result of victory is nuanced and balanced with cooperation. All the gear imposes behaviors of equitable treatment, due and fair process as internal values. These are necessary conditions for an effective, rational, fair and efficient civil process.La instauración del proceso por audiencias, con la mejora de todas las condiciones orgánicas y financieras del sistema de administración de justicia civil, no parece ser suficiente; requiere, además, fijar nuevos roles al juez y a las partes. Por el lado del juez, se impone una visión que asume un rol activo, de gerente y conductor. De esta forma, se verifica una simbiosis entre los sistemas adversarial e inquisitorio. La cultura jurídico-procesal comparada contemporánea comienza a ser condicionada en la necesidad de un juez cercano y con una intervención empática con las partes y sus representantes, que requiere una transformación de paradigmas. Por el lado de las partes, la competencia entre ellas por obtener un resultado positivo de victoria se matiza y equilibra con la cooperación. Todo el engranaje impone conductas de trato equitativo, debido y justo proceso como valores internos. Éstas son condiciones necesarias para un proceso civil eficaz, racional, justo y eficiente.
