This paper provides an analysis of the legal situation of temporary workers in Peru identifying the lack of a specific legal framework that distinguishes them from categories that, although different, are recognized under the same generic name. In this context, the author outlines the definition of a temporary worker and gathers the central characteristics of their work to differentiate them from seasonal, accidental, and substitute workers. With that said, the article presents the employee benefits they are entitled to, such as job stability, severance package and vacations, unionization, and social security. In addressing each of these, the author makes clarifications and criticisms related to the different treatment that legislation gives to temporary workers. In this vein, he proposes recommendations to improve the protection and rights of temporary workers, suggesting legislative adjustments to prevent potential abuses and promote fair and uniform treatment for this category of workers.El presente artículo brinda un análisis de la situación legal de los trabajadores eventuales en el Perú, identificando la falta de un marco jurídico específico que los distinga de categorías que, no obstante ser diferentes, son reconocidas bajo el mismo nombre genérico. En ese contexto, el autor brinda alcances de la definición de trabajador eventual propiamente dicho y reúne las características centrales de su labor para diferenciarlo del trabajador de temporada, accidental y suplente. Dicho ello, se presentan los beneficios sociales a los que tienen derecho, como la estabilidad laboral, la compensación por tiempo de servicios y vacaciones, la sindicalización y la seguridad social. En el abordaje de cada uno de ellos, el autor realiza precisiones y críticas vinculadas al diferente tratamiento que otorga la legislación a los trabajadores eventuales. En esa línea, propone recomendaciones para mejorar la protección y derechos de los trabajadores eventuales, sugiriendo unos ajustes legislativos que prevengan posibles abusos y promuevan un trato justo y uniforme para esta categoría de trabajadores.
