To gauge its importance the origins of the current rule are commented and how business reality surpassed the same. AÚN OTRA VICTORIA DEL CONSENSUALISMO* Francisco GONZÁLEZ DE COSSÍO** Desde el ángulo de derecho civil y arbitral, este estudio analiza el requisito de forma del acuerdo arbitral, en particular las reformas recientes que la Comisión de Naciones Unidas para el Derecho Mercantil Internacional ha debatido y aprobado sobre el tema. Para palpar su importancia se comentan los orígenes de la norma actual y cómo fue superada por la realidad, para luego profundizar sobre la trascendencia de la nueva regla y su impacto en el régimen de derecho arbitral. Finalmente, aplaude la modificación y sugiere que el legislador mexicano la adopte.
