Pedro Alfonso LABARIEGA VILLANUEVA * This article has the goal of ex-plaining the legal nature of endorsement, with the purpose of defining whether this institu-tion is closer to bonds (but of a peculiar nature); or to a typical commercial guarantee. In his explanation, the author develops a historical analysis concerning the emergence of endorsement and its introduction into some European and Ibero-American legal systems. Moreover, he explains which is the economic function of endorsement, and then he exami-nes the way in which this institution is governed by several international instruments that deal with negotiable documents. Finally, the author analyzes endorsement in its different elements, invoking the diverse theories that have tried to give an explanation in relation to the legal nature of this institution. Pedro Alfonso LABARIEGA VILLANUEVA * El presente artículo tiene como objetivo explicar la naturaleza jurídica del aval, para efecto de determinar si se trata de una institución afín a la fianza, pero de carácter sui generis; o bien si es una garantía cambiaria típica. En su exposición, el autor realiza un análisis histórico relativo al surgimiento del aval y su introducción en algunos sistemas jurídicos europeos e iberoamericanos. Asimismo, explica cuál es la función económica del aval, para realizar después un análisis de esta institución tal y como está regulada por diversos instrumentos internacionales que regulan la materia de títulos de crédito. Finalmente, analiza al aval en sus diversos elementos, aludiendo a las distintas teorías que han tratado de dar una explicación acerca de la naturaleza jurídica de dicha institución.
