| Description | To elaborate a new Constitution in order to conclude the process of democratic transition is the main premise of this article. The author analyzes three proposals of integral amendment to the Constitution and displays his own constructed in four planes: legal-formal, legal-material, historical and political, not seeing any problem regarding intangibly clauses nor with dual procedures of constitutional amendment. The merit of the proposal, indicates the author, is based on democratic legitimacy that is reached with the popular participation through a double referendum: to decide having a new Constitution and to confirm the results of the Constituent Assembly, every time the original Constituent is only the people and Constituent Assembly its instrument. | en-US |
| Description | Elaborar una nueva Constitución Para concluir el proceso de transición democrática es la premisa principal del artículo. El autor analiza tres propuestas de reforma integral de la Constitución, y presenta la suya propia construida en cuatro planos: jurídico-formal, jurídico-material,histórico y político; en donde no ve problema alguno respectos las cláusulas de intangibilidad y los procedimientos duales de reforma constitucional. El mérito de la propuesta, señala el autor, estriba en la legitimidad democrática que se alcanza con la participación popular a través de un referendo doble:para decidir tener una nueva Constitución y para confirmar la labor de la Asamblea Constituyente, toda vez que el constituyente originario es el pueblo y la Asamblea Constituyente su instrumento. | es-ES |
