DescriptionThe postwar constitutionalism has incorporated the dignity of the human person as a premise of the modern democratic State. But the dignity acquires all its transforming potentiality, when it is studied from an institutional non abstentionist perspective but promoting of the human person, which no longer looks to limit and to control State and society but, on the contrary, to foment or to create legal, political, social, economic and cultural conditions, that allow the development of the human person in dignity. Dignity is tied directly to the fundamental rights; trying to integrate and to weigh the human dignity with the diverse legally protected interests in the Constitution. It is indeed in the relationship between dignity and fundamental rights, where a series of old dilemmas related to the right to life and new challenges coming from the application of genetics appeared, before which the Constitutional Law cannot be far behind from the scientific, technological and social events, but it cannot go imprudently ahead either.en-US
DescriptionEl constitucionalismo de la post-guerra ha incorporado la dignidad de la persona humana como una premisa del Estado democrático moderno. Pero la dig-nidad adquiere toda su potencialidad transformadora, cuando se la estudia en una perspectiva institucional no abstencionista sino promotora de la persona humana; en la cual se busca ya no limitar y controlar al Estado y a la sociedad; si no, por el contrario, fomentar o crear las condiciones jurí-dicas, políticas, sociales, económicas y culturales, que permitan el desarrollo de la persona humana en dignidad. La dignidad está vinculada directamente a los derechos fundamentales; buscando integrar y ponderar a la dignidad humana con los diversos bienes jurídicos tutelados en la Constitución. Es precisamente en esta relación entre la dignidad y los derechos fundamentales donde se presentan una serie de viejos dilemas con relación al derecho a la vida, y de novísimos desafíos provenientes del derecho genético, frente a los cuales el derecho constitucional no puede estar tan atrás de los acontecimientos científicos, tecnológicos y sociales, como tampoco adelantarse imprudentemente a éstos.es-ES
