DescriptionThis article carries out a comparative analysis between the new laws of arbitration that have been dictated in Chile and Spain. Both laws are based on the Law Model UNCITRAL; they have been dictated recently with the intention of modernizing the by arbitration system and by means of them, both countries try to become seat of arbitration for the Hispanic world mainly. Nevertheless, the existing differences between the normative mentioned ones are not smaller. For that reason, it seems interesting to know the scene in which our new law of arbitration develops, with the intention of venturing its possible weaknesses and strengths.en-US
DescriptionEste artículo efectúa un análisis comparativo entre las nuevas leyes de arbitraje que se han dictado en Chile y España. Ambas leyes se basan en la Ley modelo UNCITRAL; se han dictado recientemente con el objeto de modernizar el sistema arbitral y por medio de ellas, los dos países pretenden convertirse en sede de arbitraje principalmente para el mundo hispánico. Sin embargo, las diferencias existentes entre las citadas normativas no son menores. Por ello, parece interesante conocer el escenario en que se desenvuelve nuestra nueva ley de arbitraje, con el objeto de aventurar sus posibles debilidades y fortalezas.es-ES
