Número 105Septiembre - Diciembre 2002Nueva Serie Año XXXVISSN 0041 8633 EL CRIMEN DE GENOCIDIO EN DERECHO INTERNACIONAL Alonso GÓMEZ-ROBLEDO VERDUZCO * This is an article whose aim is to explain the concept and implications of the crime of genocide, on the basis of an analysis of different international instruments that regulate it, and the examination of the Jean-Paul Akayesu and Pinochet cases. Firstly, the author studies the antecedents and evolution of the regulation of genocide as an interna-tional crime, starting from the Convention to prevent and punish the crime of genocide of 1948, up to the Statute of Rome on the International Criminal Court of 1998. Se-condly, he examines the elements of the definition of genocide, such as the material acts that constitute it, the intention and forms of participation. Lastly, the author explains some of the limitations of the 1948 Conven-tion and of the Project of Code of Crimes against International Peace and Security, concerning the way in which these instru-ments regulate the crime of genocide. En primer lugar, el autor analiza los antecedentes y desarrollo de la regulación del crimen de genocidio, desde la Convención para la Prevención y la Sanción del Delito de Genocidio de 1948, que lo regula por primera vez, hasta el Estatuto de Ro-ma de la Corte Penal Internacional de 1998. En segundo lugar, realiza un estudio de los elementos de la definición de genocidio, tales como los actos materiales que lo constituyen, la intención y las modalidades de participación. Finalmente, explica cuáles son las limi-taciones de la Convención de 1948 y el Proyecto de Código de Crímenes contra la Paz y la Seguridad Internacionales con el que se pretende regular el genocidio.
