Número 105Septiembre - Diciembre 2002Nueva Serie Año XXXVISSN 0041 8633 REFLEXIONES JURÍDICAS EN TORNO A LOS SUJETOS QUE INTERVIENEN EN UN TRASPLANTE DE ÓRGANOS Ingrid BRENA SESMA * The goal of this article is to put forward a series of reflections concerning the subjects of human organs and the way in which different legal systems regulate their conduct and asign to such conduct legal consequences. The author starts from the premise that the donation of organs can imply that the transplant occurs during the life-time of the donor, or after the latters death. She considers that the transplant during the donors lifetime is subject to certain limita-tions, taking into account that it can produce a detriment to the donors health in an irre-mediable way. On the other hand, she examines the different hypothesis that can arise in the case of dontations in which the actual transplant of organs take place after the donors death. Moreover, the author analyzes Mexican and other countries-legis-lation concerning the donation of organs of minors. Lastly, she studies the rights and duties of the recipients of organs and of the medical team that participate in a transplant. La autora parte de que la donación puede ser en vida o para después de la muerte. Considera que la donación en vida tiene ciertos límites tomando en cuenta que ésta puede implicar para el donante algún perjuicio grave o el menoscabo de su salud en forma irremediable. Por otro lado, examina las distintas hipótesis que pueden darse en las donaciones para después de la muerte. Asimismo, analiza la legislación nacional y extranjera que regula la donación de órganos de los menores de edad. Por último, analiza los conceptos, derechos y deberes del receptor y del equipo médico que participa en un transplante de órganos.
