The particular, typical figure of swindle, where the victim of the deception cooperates in the cause of the harm, forces the interpreter to wonder to what extent such a conduct can affect the results from the imputation on the perpetrator’s conduct. In the last few years, most of the academic debate, particularly in the comparative doctrine and jurisprudence, has been centered on this offense, on the victim’s negligent conduct, and on its consequences for the constitution of the deception. Both the scope of this discussion and the projection it may have for the resolution of various cases in Chile make up the content of this presentation.La particular configuración típica del delito de estafa, donde la víctima del engaño coopera en la producción del perjuicio, obliga al intérprete a preguntarse en qué medida dicho comportamiento puede afectar la imputación del resultado a la conducta del autor. En los últimos años, especialmente en la doctrina y jurisprudencia comparada, la conducta negligente de la víctima y sus consecuencias para la configuración del engaño, ha centrado gran parte del debate académico sobre este delito. El alcance de esta discusión y la proyección que puede tener para la resolución de diversos casos en nuestro país, constituye el contenido de esta presentación.
