As part of a research project that aims at studying the way Chilean law has undertaken the protection of both public faith and state functions, this article addresses, from a dogmatic and critical perspective, the issue of penal protection of the jurisdictional function. After looking into several present systematic options in comparative law, the article conceptually defines the sense properly attributed to the practice of such a function, as object of penal protection, and the legal basis for including it in the juridical rights deserving protection in the scope of the Penal Code. The study concludes with a reference to the behaviors that can be considered prejudicial to such an interest and to the systematic typification of protectionoriented offenses.Enmarcado en un proyecto de investigación que tiene por objeto el estudio de la forma en que el Derecho chileno asume la protección de la fe pública y de las funciones estatales, el trabajo aborda, desde una perspectiva dogmática y crítica, el tema de la tutela penal de la función jurisdiccional. Tras examinar las distintas opciones sistemáticas vigentes en el Derecho comparado, el texto delimita conceptualmente el sentido que corresponde atribuir al ejercicio de aquella función, en tanto objeto de protección penal, y la procedencia de incluirlo entre los bienes jurídicos merecedores de tutela en el ámbito del Derecho Penal. Concluye el estudio con una referencia a las conductas que pueden ser consideradas como lesivas de aquel interés y a la ubicación sistemática de los delitos orientados a su tutela.
