<summary type="text">¿Towards “False Consciousness” or towards “Class  Consciousness”? Notes concerning ideology in Marx’s Works; ¿Hacia la “falsa conciencia” o hacia la “conciencia  de clase”? Apuntes en torno a la ideología en la obra de  Marx
The purpose of this paper is to contribute to the discussion on the notion of ideology in Marx’s work, and it attempts to follow the development carried out by the author in order to unravel its significance. The following texts are used as reference material: The German ideology, written with Engels, and Capital, the first chapters in particular.Two focuses of analysis are proposed. On the one hand, starting from the assumption that Capital is the work with which Marx achieves the highest level of scientific development around the concept of ideology as the individual’s mode of consciousness, ideology is presented as the estrangement of consciousness within capital as the general social relation within the capitalist mode of production; and consequently, the working class, as holder of the need to supersede capitalism, does not need to develop its own class ideology but move forward critically over its estrangement. On the other hand, the legal system constitutes the set of legal forms in which the capitalist social relation is expressed, and has an ideological function; for a criticism of the “roots” of such social relation, it will not be worth formulating a critical theory of law but a critique of law instead.; Este trabajo se propone intervenir en la discusión sobre la noción de ideología en la obra de Marx, tratando de seguir el curso del desarrollo que realiza el autor para desentrañar su significación. Se toman como referencia los textos: La ideología alemana, que produjo junto a Engels, y El Capital, en particular los primeros capítulos.Se proponen dos ejes de discusión. Por un lado, partiendo de la hipótesis de que El Capital es la obra en que Marx alcanza el mayor desarrollo científico en torno a la ideología como forma de la conciencia de los individuos, se plantea que la ideología es la enajenación de la conciencia en el capital como relación social general en el modo de producción capitalista; y, en consecuencia, la clase obrera, como portadora de la necesidad de superación del capitalismo, no necesita desarrollar su ideología de clase, sino avanzar críticamente sobre su enajenación. <summary type="text">Psychoanalysis and Law:  Elements for a lacanian critique of the ideology of Law; Psicoanálisis y derecho: elementos para una crítica  lacaniana de la ideología jurídica
:This paper seeks to explain a new way of carrying out the critique of the juridical ideology, inspired in the Lacanian teaching. After noticing the importance of the study of the Law as a form, the avoidance of the fascination for its hidden content s promoted, driving the legal analysis to look the juridical form as such. In this context, warning is made in relation to the constitutively divided character of Law, this means the presence of a negativity inherent to its structure that, nevertheless, enables the approach of The Political in the juridical. It also proposes a symptomatic approach to the juridical form capable of taking account of the signs of the irruptions of The Real of the antagonism in the juridical form. Finally, it points out the Lacanian notion of fantasma as a key concept in order to understand the juridical-ideological operations by means of which the individuals are affectively subjected in the repetition of de dominant order of things.; Este artículo busca dar cuenta de una manera novedosa de llevar adelante la crítica de la ideología jurídica, inspirada en la enseñanza lacaniana. A partir de señalar la importancia del estudio del derecho en tanto forma, se promueve eludir la fascinación por su contenido oculto, en pos de dirigir el análisis hacia la apariencia jurídica en cuanto tal. En ese marco, se advierte acerca del carácter constitutivamente dividido del derecho, es decir, de la presencia de una negatividad inherente a su estructura que, sin embargo, habilita el abordaje de Lo Político en lo jurídico. Asimismo, se propone un enfoque sintomático de la forma jurídica susceptible de prestar atención a los signos de las irrupciones de Lo Real del antagonismo en el semblante normativo. Por último, se señala a la noción lacaniana de fantasma como un concepto clave a la hora de comprender las operaciones jurídico-ideológicas por medio de las cuales se sujeta afectivamente a los individuos en la repetición del orden de cosas dominante

This paper is centered in the sociological theory of labor law and legal sociology of workers’ fundamental rights, according to the methodology of critical legal theory of Oscar Correas. The task of sociological theory of labor law is a description of deontic modalities and the behaviors needed for commercial exchange and the use of the labor force. On the other hand, the task of legal sociology of labor law is to verify the compatibility between the deontic modalizators of behavior necessary for the purchase and sale and the use of labor force and constitutional law deontic modalizators in the Brazilian constitutional labor rights (the basic rights of workers in CRFB/1988).; El presente artículo constituye un trabajo de teoría sociológica del derecho del trabajo y de sociología jurídica de los derechos fundamentales del trabajador, partiendo de la metodología jurídica crítica de Oscar Correas. La tarea de la sociología del derecho del trabajo consiste en la descripción y la modalización deóntica de las conductas necesarias para la compra-venta y el uso de la fuerza de trabajo y los modalizadores deónticos del derecho constitucional brasileño del trabajo (derechos fundamentales del trabajador en la CRFB/1988).

<summary type="text">Legal Pluralism and Communitarian  Justice in Latina-America: Potentialities from a Sociology of  Abscences and of Emergences; Pluralismo Jurídico e Justiça Comunitária na América  Latina: Potencialidades a parir da Sociologia das Ausencias  e das Emergencias
It is a study that seeks to identify in the context of legal pluralism and the Latin American geopolitical space manifestations of an emancipatory legality, produced outside the monistic conception of traditional law by historically subject (so) denied in its popular culture. The analysis starts from the investigation on the expression of community justice in the context of the Andean countries and an alternative justice in the Brazilian territory, in its various forms and mechanisms, due to the inclusion of a theory of sociology and sociology of absences and emergencies legal paradigm for the global South from the ideas of Boaventura de Sousa Santos. This task meets other forms of justice to say, different from the liberal legal tradition of production in the right atomized individuals, turning their eyes to the realities of Latin American periphery, where there is insertion of a new legal rationale germinated with emancipatory thrust of otherness. Methodology contained in the literature review, desk research and an indirect method and sociological comparison of procedural experience different realities expressed in the Latin American continent is using as a theoretical framework of legal pluralism and participatory community type proposed by Antonio Carlos Wolkmer. It also demonstrates how the results of different manifestations of justice produced or alternatives for integration, identity and social belonging of the subjects involved, may have a bias to the right critical Europeanized legal epistemology, fragmented, exclusionary and hegemonic / colonization; Trata-se de um estudo que busca identificar no contexto de pluralismo jurídico e no espaço geopolítico latino-americano manifestações de uma juridicidade emancipatória, produzida fora da concepção monista do direito tradicional, por sujeitos historicamente (so)negados em sua cultura popular. A análise se dá a partir da investigação sobre a manifestação de justiça comunitária no contexto de países andinos e uma justiça alternativa na territorialidade brasileira, em suas diversas modalidades e mecanismos, diante da inserção de uma teoria da sociologia das ausências e uma sociologia das emergências como paradigma jurídico para o Sul global a partir das idéias de Boaventura de Sousa Santos. Tal tarefa cumpre afirmar outras formas de justiça, diferenciada da tradição jurídica liberal de produção do direito atomizado em indivíduos isolados, voltando os olhares para as realidades periféricas latino-americanas, onde há inser-ção de uma nova racionalidade jurídica germinada com ímpeto emancipatório de alteridade. Consta da metodologia a análise bibliográfica; pesquisa documental indireta e um método procedimental comparativo e sociológico das experiências manifestadas em diferentes realidades do continente latino-americano se utilizando como marco teórico o Pluralismo Jurídico de tipo comunitário e participativo proposto por Antonio Carlos Wolkmer. Busca-se demonstrar como os resultados de manifestações diferenciadas ou alternativas de justiça produzidas para integração, identidade e pertinência social dos sujeitos envolvidos, podem apresentar um viés de direito crítico à epistemologia jurídica europeizada, atomizada, excludente e hegemônica/colonizadora.
