| Description | The Internet is, without a doubt, a phenomenon that now permeates every field of human life. Since its origins, it has tried to be regulated by Law, but because of its transcendence in the development of people and for the exercise of other human rights, it has started to be considered as a human right in and of itself. Various documents and judicial resolutions have hazarded already to recognize the right of access to the In-ternet as a true human right. This present work addresses such documents to attempt to construct its judicial nature and recognizes it as a positive status right that requires speci-fic actions by the State for its materialization. It is also addressed as an instrumental right, which makes possible the full exercise of many other human rights. | en-US |
| Description | La Internet permea hoy en día en todos los ámbitos del ser humano. Desde sus orígenes, ha sido un fenómeno que ha tratado de ser regulado por el derecho. Debido a su trascendencia para el desarrollo de las personas y para el ejercicio de otros derechos humanos, hacen que se le empiece a considerar como un derecho humano. Va-rios documentos y resoluciones judiciales se han aventurado ya, a reconocer el derecho de acceso a la Internet como un verdadero derecho humano. El presente trabajo aborda dichos documentos para tratar de construir la naturaleza jurídica y lo reconoce como un derecho de status positivo que requiere de mandatos de acción por parte del Estado para su materialización. También se aborda como un derecho instrumental que hace posible el pleno ejercicio de muchos otros derechos humanos. | es-ES |
