DescriptionThe text addresses the problems related to the challenge and review in court decisions, adopted during the criminal process, by virtue of potential errors in the assessment of the evidence and determination of the factual premises. First of all, the apparent tension between, on the one hand, the guarantee to double conformity by means of an integral remedy and, on the other, the principle of immediacy from which it would follow that the trial court is sovereign in the evaluation of the evidence. From there, and after a reconstruction of the manner in which the probative reasoning has to be reflected in the judicial decision in accordance with the requirements of the CPEUM and the CNPP, it is demonstrated that this tension is more apparent than real. This makes it possible to say that the solution of the CNPP in excluding the questions concerning the assessment of the evidence as possible grievances to argue through the appeal is a bad solution. This is especially so because it is intended to be a solution to a problem that is largely non-existent. .en-US
DescriptionEn el texto se aborda la problemática relativa a la impugnación y revisión en alzada de decisiones judiciales, adoptadas durante el proceso penal, en virtud de potenciales errores en la valoración de la prueba y fijación de las premisas fácticas. En primer lugar, se pone de manifiesto la aparente tensión entre, por una parte, la garantía a doble conforme por medio de un recurso integral y, por la otra, el principio de inmediación, del que se seguiría que el tribunal de juicio es soberano en la valoración de la prueba. A partir de allí, y luego de una reconstrucción del modo en que el razonamiento probatorio ha de plasmarse en la decisión judicial de conformidad con las exigencias de la CPEUM y del CNPP, se demuestra que esa tensión es más aparente que real. Esto permite sostener que la solución del CNPP al excluir las cuestiones concernientes a la valoración de la prueba como posibles agravios a alegar por medio del recurso de apelación es una mala solución. Ello así, sobre todo, en virtud de que pretende ser una solución para un problema en gran medida inexistente.es-ES
