DescriptionIn the reform process of the yore Constitution of Mendoza, this project has as purpose explaining the tensions occurring in constitutionalism as to popular sovereignty, el constitutional branch and the place of the people. In this theoretical framework, the hypothesis adopted consists of the difficulty to materialize constitutional change obeys to the attempts are exclusively addressed to legal procedures, which were not designed to favor the democratic and discursive exchange of reasoning between the State and the people. Facing this problem, the development of “extra-constitutional” practices derived from a deliberative theory of democracy, will contribute to provide democratic legitimacy to the actual reform.en-US
DescriptionEn el proceso de reforma de la centenaria Constitución de Mendoza, el presente trabajo tiene por objeto explicitar las tensiones habidas al interior del constitucionalismo en los aspectos atinentes a la soberanía popular, el poder constituyente y el lugar del pueblo. Dentro de ese marco teórico, la hipótesis adoptada consiste en que la dificultad para materializar el cambio constitucional obedece a que los intentos se ciñen sólo a procedimientos legales, que no fueron diseñados para favorecer el intercambio democrático y discursivo de razones entre el Estado y el pueblo. Frente a esa problemática, el desarrollo de prácticas “extraconstitucionales”, que surgen de una teoría deliberativa de la democracia, contribuiría a dotar de legitimidad democrática la eventual reforma.es-ES
