DescriptionThis research starts at the lack of quantitative relevance that the topic of legal status of the international immigrant for labor reasons continues to have amidst the action of the regional Inter-American bodies for the protection of human rights. Concern for the rights of migrant workers and their families is becoming more important as flows to countries that until now have been issuers and non-recipients increase. The Commission and the Court have referred to various situations in which their status as non-nationals places them in a situation of vulnerability that has a direct impact on the violation of their rights, with the immigration control measures and practices exercised by the states constituting the situations that give rise to the greatest number of cases. Although jurisprudence takes into account the principle of equality and non-discrimination based on the immigration status and protection of labor rights, this research concludes that there is still much work to be done in terms of establishing the guarantees of freedom of movement and residence, the acquisition of nationality, and the rights of international immigrants in an irregular administrative situation.en-US
DescriptionLa investigación parte de la falta de relevancia cuantitativa que el tema del estatuto jurídico del inmigrante internacional por razones laborales tiene todavía en el conjunto de la acción de los órganos regionales interamericanos de protección de derechos humanos. La preocupación por los derechos de los trabajadores migrantes y de sus familias está adquiriendo importancia en la medida en que aumentan los flujos hacia países que hasta el momento habían sido emisores y no receptores. La Comisión y la Corte se han referido a diversas situaciones en las que su condición de no nacionales les coloca en una situación de vulnerabilidad que repercute directamente en la violación de sus derechos, siendo las medidas y prácticas estatales en materia de control migratorio aquellas situaciones que dan origen al mayor número de casos. Aunque la jurisprudencia está tomando muy en cuenta el principio de igualdad y no discriminación en razón del estatus migratorio y la protección de los derechos laborales, la investigación concluye que todavía queda mucho trabajo que hacer en cuanto al establecimiento de las garantías de la libertad de circulación y residencia, la adquisición de la nacionalidad y los derechos de los inmigrantes internacionales en situación administrativa irregular.es-ES
