Description	In this paper the author analyzes how, from the disappearance of the Welfare State thanks toNeoliberal politics, the Rule of Law has turned into a Rule of Fact. In contrast to the Neoliberal State,social actions and movements that are rethinking Law and State from the view point of the constituentpower of popular sovereignty are emerging. Description	En el presente trabajo se analiza cómo, a raíz de un estado neoliberal mínimo en lo que hacea sus funciones de ayuda social, pero máximo en lo correspondiente a su apoyo a la dominación capitalista,el Estado de Derecho se ha convertido en un Estado de hecho. Por otro lado, y frente a esta situación,emergen movimientos y acciones sociales que comienza a pensar otro Derecho y Estado originado desdeel poder constituyente de la soberanía popular, a partir del cual la separación entre Estado y sociedad civiltiende a desaparecer para producir un Derecho vivo y societal	es-ES
