DescriptionRecently, the review chamber of the Constitutional Court of Colombia selected, for study, a petition in which a woman (Patricia), on behalf of her young son (Camilo), claimed custody of two dogs, Aurelio and Virgilio, whose care responsibility within the family she acquired when she entered into a de facto marital union with Luis. The judge who ruled in the first instance opted to leave the dogs to Laura, with whom Luis had a marital union, who also claimed custody of the animals because she had acquired them. Does the emotional bond prevail over the right of ownership in a decision of this nature? The Court considered the matter of such importance and topicality that it convened a session with scholars from different fields of knowledge. The following are the answers I gave to the questions posed by the High Court to pronounce, in depth, on whether it is possible to grant companion animals recognition as members of a family.en-US
DescriptionRecientemente, la sala de revisión de la Corte Constitucional de Colombia seleccionó, para estudio, una tutela en la que una mujer (Patricia), en nombre de su hijo pequeño (Camilo), reclamaba la custodia de dos perros, Aurelio y Virgilio, cuya responsabilidad de cuidado en el seno familiar adquirió al conformar unión conyugal de hecho con Luis. El juez que falló en primera instancia optó por dejarle los perros a Laura, con quien Luis tenía unión matrimonial, quien también reclamaba la custodia de los animales por el hecho de haberlos adquirido. ¿Prima el vínculo afectivo sobre el derecho de propiedad en una decisión de esta naturaleza? La Corte consideró el asunto de tal importancia y actualidad, que convocó a una sesión con estudiosos de diferentes campos del conocimiento. Las siguientes son las respuestas que di a las preguntas que nos planteó el Alto Tribunal para pronunciarse, a fondo, sobre si es posible otorgarles a los animales de compañía reconocimiento como integrantes de una famila.es-ES
