DescriptionIn this paper, Dr. Fernando Liendo analyzes the original interpretation of the Constitution, exposing its main points and how he reconstructs the intentions of the past and translates them into different eras. The author also exposes the theoretical adversary called Living Constitution and, based on the established elements and evidence provided, reasons about the possibility of applying originalism to an European or Latin American Continental law system, as an additional interpretative method that can be used by the courts when they aim to consolidate a “normative state‟ that they consider legitimate to preserve.en-US
DescriptionEn el presente artículo, el Dr. Fernando Liendo realiza un análisis sobre la interpretación originalista de la Constitución, exponiendo las notas centrales y cómo reconstruye las intenciones del pasado y las traduce a épocas distintas. El autor expone también al adversario teórico denominado Living Constitution y, en base a los elementos establecidos y evidencias aportadas, razona sobre la posibilidad de aplicarse el originalismo a un sistema de Derecho Continental europeo o latinoamericano, como un método interpretativo adicional que puede ser empleado por los tribunales cuando apunten a consolidar un „estado normativo‟ que juzguen legítimo conservar.es-ES
